Terms and Conditions
These terms govern the pattern-making services that A Modelista provides to anyone who requests them through this website, by email or by phone. By accepting a quote, you accept these terms.
Who we are
A Modelista: Contact: info@modelista.pt.
Services
We develop custom clothing patterns in CLO 3D from sketches, reference photos or existing garments, and grade sizes. Patterns are delivered as PDF, as plotter files or on paper.
Requests and quotes
Every request receives a free, personalised quote with no obligation. The quote states the price, the deadline, what is included and how the work will be delivered, and is valid for the period it states. The contract is formed when you accept the quote in writing, for example by replying to the email.
Prices and payment
Prices and payment terms are those of the accepted quote, which also states whether VAT and shipping are included.
Information provided by the client
The pattern is made from the measurements, size charts, sketches and references you send us. Errors or omissions in that information may affect the result; if we spot an inconsistency, we tell you before going ahead. By sending drawings or photos, you confirm that you have the right to use them for this purpose.
Adjustments
Adjustments to the pattern within what was agreed in the quote are included. Changes to the scope of the work, such as a different design or additional sizes, are quoted separately and only go ahead with your agreement.
Deadlines and delivery
Deadlines are those in the quote and run from acceptance and receipt of all the information needed. Digital files are sent by email or by download link. For physical shipments, shipping costs and transit times are stated in the quote.
Rights over the work
The design of the garment remains yours. Once the work is paid for, you may use the delivered patterns to produce your garments. We only show work made for clients, on the website or elsewhere, with their permission.
Right of withdrawal
If you contract as a consumer at a distance, you generally have 14 days to withdraw from the contract without giving a reason (Portuguese Decree-Law 24/2014). This right does not apply to goods made to the consumer's specifications or clearly personalised, nor to digital content or services already supplied with your prior express consent. As every pattern is made to measure, we ask for that consent in writing before starting the work.
Conformity and liability
We guarantee that the patterns match what was agreed. If a pattern contains an error on our part, we correct it free of charge. We are not liable for results that depend on cutting, sewing or materials chosen by third parties. Nothing in these terms limits the rights that the law grants to consumers.
Complaints and dispute resolution
You can file a complaint in the Portuguese Electronic Complaints Book. In a consumer dispute, you can also turn to an alternative dispute resolution body, such as CNIACC, the Portuguese National Consumer Arbitration Centre (www.cniacc.pt). The full list of these bodies is on the Portuguese Consumer Portal.
Governing law
These terms are governed by Portuguese law.
Changes
We may update these terms and the date at the top changes with them. Work already accepted follows the terms in force on the date of acceptance.
